The “American-style” class action, when combined with private rights, is an important tool of American regulatory policy. And just as American regulation has global reach, the global class action is not unfamiliar to U.S. courts. Yet, global U.S. class actions are facing ever-stronger headwinds. In addition to the recent retrenchment of class actions and international litigation generally, U.S. courts have raised additional barriers to global class actions in particular. This Article’s first goal, therefore, is to document these developments and their (...) consequences for regulation. Against this backdrop, this Article also reviews the options available to foreign lawmakers, foreign courts, foreign litigants and litigation funders, and foreign public enforcers. Foreign lawmakers may provide alternatives to global U.S. class actions; foreign courts and foreign litigants may explicitly or implicitly coordinate to approximate global class resolution; and foreign public enforcers may achieve the goals of global regulatory litigation while avoiding some of its legal impediments. Finally, this Article evaluates these various foreign responses from an institutional perspective, with special attention to the institutional incentives for lawmakers and law enforcers. (shrink)

Efforts from diverse disciplines, including evolutionary studies and biomechanical experiments, have yielded new insights into the genetic, signaling, and mechanical control of tooth formation and functions. Evidence from fossils and non‐model organisms has revealed that a common set of genes underlie tooth‐forming potential of epithelia, and changes in signaling environments subsequently result in specialized dentitions, maintenance of dental stem cells, and other phenotypic adaptations. In addition to chemical signaling, tissue forces generated through epithelial contraction, differential growth, and skeletal constraints act (...) in parallel to shape the tooth throughout development. Here recent advances in understanding dental development from these studies are reviewed and important gaps that can be filled through continued application of evolutionary and biomechanical approaches are discussed. BackgroundInformed consent is a key element of ethical clinical research. Addicted population may be at risk for impaired consent capacity. However, very little research has focused on their comprehension of consent forms. The aim of this study is to assess the capacity of addicted individuals to provide consent to research.Methods53 subjects with DSM-5 diagnoses of a Substance Use Disorder and 50 non psychiatric comparison subjects participated in the survey from December 2014 to March 2015. This cross-sectional study was carried out (...) at a community-based Outpatient Treatment Center and at an urban-located Health Centre in Spain. A binary judgment of capacity/incapacity was made guided by the MacArthur Competence Assessment Tool for Clinical Research and a clinical interview. Demographics and clinical characteristics were assessed by cases notes and the Mini-Mental State Examination, the Global Assessment Functional Scale and the Clinical Global Impression Scale.ResultsNPCs performed the best on the MacCAT–CR, and patients with SUD had the worst performance, particularly on the Understanding and Appreciation subscales. 32.7 % SUD people lacked research-related decisional capacity. There were no statistically significant differences between the groups in terms of capacity to consent to research.ConclusionsThe findings of our study provide evidence that a large proportion of individuals with SUD had decisional capacity for consent to research. It is therefore inappropriate to draw conclusions about capacity to make research decisions on the basis of a SUD diagnosis. In the absence of advanced cognitive impairment, acute withdrawal or intoxication, we should assume that addicted persons possess decision-making capacity. Thus, the view that people with SUD would ipso facto lose decision-making power for research consent is flawed and stigmatizing. (shrink)

This book explores Dostoevsky as a political thinker from his religious and philosophical foundation to nineteenth-century European politics and how themes that he had examined are still relevant for us today.

This book is a qualitative, interpretive, phenomenological, and interdisciplinary, examination of food and food practices and their meanings in the modern world. Each chapter thematically focuses upon a particular food practice and on some key details of the examined practice, or on the practice’s social and cultural impact.

Although mind‐wandering research is rapidly progressing, stark disagreements are emerging about what the term “mind‐wandering” means. Four prominent views define mind‐wandering as (a) task‐unrelated thought, (b) stimulus‐independent thought, (c) unintentional thought, or (d) dynamically unguided thought. Although theorists claim to capture the ordinary understanding of mind‐wandering, no systematic studies have assessed these claims. Two large factorial studies present participants (N = 545) with vignettes that describe someone's thoughts and ask whether her mind was wandering, while systematically manipulating features relevant to (...) the four major accounts of mind‐wandering. Dynamics explains between four and 40 times more variance in participants' mind‐wandering judgments than other features. Our third study (N = 153) tests and supports a unique prediction of the dynamic framework—obsessive rumination contrasts with mind‐wandering. Our final study (N = 277) used vignettes that resemble mind‐wandering experiments. Dynamics had significant and large effects, while task‐unrelatedness was nonsignificant. These results strongly suggest that the central feature of mind‐wandering is its dynamics. (shrink)

The diverse essays in this volume speak to the relevance of phenomenological and psychological questioning regarding perceptions of the human. Several related issues are raised by the comments of Heal and Reginster, and to avoid repetition I will discuss them together here. Both of them raise questions about the scope and authority of rationality over a person’s beliefs and other attitudes, and ask what is supposed to be wrong with adopting what I describe as (...) a spectator’s point of view on oneself, and whether this stance by itself involves the evasion of rational responsibility for one’s attitudes. They also, in their different ways, provide searching discussions of the ‘rakehell’ case from Chapter 5, where several of these issues come together, so I’d like to respond to those parts of their comments together as well. Résumé Dans cet article, j’explore l’idéalisme d’Érigène selon ses propres termes et conditions, en tentant de saisir la nature spécifique de son application théologique, métaphysique et épistémologique de la relation entre être et non-être. Je suggère que les idéalistes allemands ont raison de considérer Érigène comme l’un des leurs pour sa reconnaissance de l’univers comme un processus d’articulation de soi et de compréhension de soi de l’esprit divin. L’explication d’Érigène de la nature de toutes les existences comme essentiellement immatérielles, son (...) classement ontologique du monde apparemment physique, matériel et sensible sous le niveau de l’esprit et dans un sens spécifique, dépendant de l’esprit, et sa compréhension de toutes choses comme contenues dans l’esprit divin (et par extension dans l’esprit humain comme imago dei ) doivent être considérés non seulement comme constituant un système philosophique original à part entière, mais aussi comme un idéalisme dynamique et intellectualiste. La nature infinie d’Érigène implique l’interaction dialectique du caché et de la manifestation, du néant et de l’être, de l’esprit inconnu de lui-même qui en vient à la connaissance de soi dans un savoir et un non-savoir infinis. L’article se propose de vérifier le caractère néoplatonicien de la métaphysique d’Ammonius, fils d’Hermias, dans le dialogue intitulé Ammonius de Zacharie de Mytilène. Jusqu’à présent la recherche a cru pouvoir conclure de ce texte que la pensée d’Ammonius se rapprochait à certains égards du christianisme. Plusieurs éléments dans l’ Ammonius prouvent pourtant sans équivoque que le chef d’école alexandrin est resté fidèle au néoplatonisme païen, et notamment à la distinction proclusienne entre l’éternité divine et la perpétuité du monde.

En général, une personne sait ce qu’elle pense, veut, ou ressent, sans avoir besoin pour cela de s’appuyer sur des observations d’elle-même. En ce sens, la connaissance de soi semble bénéficier d’un privilège par rapport à la connaissance d’autrui, celui de pouvoir apparaître comme vraie sans être fondée sur l’observation et l’inférence. Ce privilège se nomme, après Wittgenstein, l’« autorité de la première personne ». Pour expliquer ce phénomène, la métaphysique traditionnelle a postulé, à l’instar du cogito cartésien, que le (...) sujet aurait une sorte d’accès direct à son intériorité que ne peut avoir autrui. Or, la plupart des philosophes contemporains rejettent l’idée d’intériorité « privée », mais ils ne s’accordent cependant pas sur l’explication qui devrait la remplacer. Ce chapitre se concentre sur la solution que Richard Moran apporte à ce problème. Moran reprend la thèse sartrienne selon laquelle pour savoir et dire ce que je pense, veux, ou vais faire, je suis obligé de me décider, de m’engager plutôt que de m’observer. En ce sens, soutient Moran, le trait distinctif de la connaissance de soi en première personne n’est pas tant un privilège qu’une responsabilité à assumer. Mais pour s’engager de façon responsable, ne faut-il pas chercher d’abord à se connaître ? Nous considérons la force de cette objection, soulevée par Ferdinand Alquié contre Sartre, et tâchons d’y répondre. Ce faisant, notre but est de montrer en quoi l’engagement d’une personne exige un rapport à soi sans équivalent dans ses rapports à autrui. (shrink)

Partant de l'idée énoncée par le philosophe Charles Taylor, selon laquelle les êtres humains sont « des animaux capables d'auto-interprétation », cet article vise à comprendre le rôle constitutif de l'auto-interprétation dans la connaissance de soi. Une conception satisfaisante de l'auto-interprétation devrait à la fois rendre compte de l'autorité de la connaissance de soi en première personne et satisfaire les exigences du réalisme ordinaire. Si la version constitutiviste de l'auto-interprétation semble incompatible avec de telles exigences, c'est parce qu'elle considère ce (...) pouvoir constituant comme le privilège du sujet de modeler ses états mentaux au gré de sa volonté. Pour autant, il est possible de conserver un rôle constitutif à l'auto-interprétation en évitant toute implication volontariste et en maintenant une certaine indépendance des contenus mentaux du sujet envers lui-même. C'est ce que proposent les philosophes américains Richard Moran et David Finkelstein, le premier, en redéfinissant l'activité d'auto-interprétation en termes de croyance impliquant l'adhésion du sujet à ses attitudes mentales. Considérant le sujet en tant qu'agent responsable de ses attitudes, Moran défend une conception cognitive et engagée de l'interprétation, un point de vue pratique du sujet sur lui-même. La délibération fournit ainsi les raisons d'adopter une croyance, un désir, une émotion,... raisons qui justifient en même temps l'auto-interprétation. Moins attaché à la valeur cognitive de l'auto-interprétation, Finkelstein développe également une conception pratique de la connaissance de soi, fondée sur la fonction expressive des auto-attributions et où l'auto-interprétation a valeur de contexte de cela même qu'elle interprète. In this paper, I recount the history of the International Journal of Philosophical Studies (IJPS), and my role as Founding Editor. The IJPS emerged from the earlier annual Philosophical Studies (Maynooth), founded by Desmond Bastable in 1951 and published regularly until 1988. I took over as Editor from 1989 to 1992 and then began the International Journal of Philosophical Studies.
